TITLE
A new European study to identify and analyse the best practices and strengths of the industrial relations of self-employed workers: representation beyond administration, the possible leadership of SME

 

The project will aim to improve expertise in industrial relations and to promote the exchange of information among parties actively involved in industrial relations. In particular, the project will deal with industrial relations of self-employed workers and their employees considering self-employment and SME synonyms. In particular, the project will aim to realize a study at two different levels. Top-down: to understand the impact of SME in the economy. Bottom-up: to identify the best practices of leadership in the representation of self-employed work. Then, an international conference will be organized in Rome to present the results of the project.

The project has been elaborated according to the experience of all the partners involved. The partnership is heterogeneous involving organisations linked to industrial relations as: Research centres and institutes, Non-profit making organisations and Self-employed trade unions in order to represent all the target groups and stakeholders and coming from 8 countries: Hungary, Bulgaria, Slovak Rep, Poland, Spain, Greece, France and Italy.

The partners have identified two different target groups: the workforce that is employed in SME and specific categories of self-employed workers who are represented by new trade unions as gas station workers, street peddlers, newsstand workers, sales representatives and bartenders.

Finally, the project expected results will be: 1. Identification, collection and analysis of the available best practices of the industrial relations of self-employed in Europe to compare the different situations in the participating countries. 2. Exploitation of the identified best practices to raise the knowledge about the impact of SME in EU economy and the leadership in the representation of self-employed work. 3. Organisation of an international conference in Rome to present the study results and to share experiences and best practices and involve counterparts, stakeholders and other EU countries.

SPECIFIC PROGRAMME "CRIMINAL JUSTICE" (2007-2013)- CALL FOR PROPOSALS 2009 JLS/2009/JPEN/AG - SPECIFIC TRANSNATIONAL AND NATIONAL PROJECTS


TITLE: Identification and dissemination of European best practices about the restorative justice and evaluation of the role and application of the mediation and the alternative measures in the EU member states.

GENERAL FRAMEWORK:

The overall objective of the project is the collection, dissemination, promotion of good practices at transnational level on programs of restorative justice and mediation and the non-custodial treat-ment measures. It should also highlighted the aim of contributing to the adaptation of participat-ing countries legal system as promised, in particular, the application programs of restorative jus-tice and mediation (see the European Union Council Framework Decision on the position of victims in criminal proceedings, 2001/220/JHA of 15 March 2001 and the Resolution on Action Plans to implement the Vienna Declaration on Crime and Justice: the new challenges of the twenty-first century, the United Nations General Assembly - No 56/261, 31/01/2002, and the resolution on the Basic Principles on the application of restorative justice programs in criminal matters, Economic and Social Council of the United Nations No 15/2002).

OBJECTIVES:
Specifically, the project aims to:
1. Identify pathways of excellence in the treatment of:
a) children (14-18 years) and young adults (who have committed the crime aged less than 18) borne by the juvenile justice system.  
b) adults in execution of punishment that may have initiated pathways of reflection "about possi-ble remedial actions for the consequences of the crime" taking into account the rights of the vic-tim.
Participating countries should identify measures that include: for children and young adults, pro-cedural interventions aimed at reducing the use of imprisonment as advocated by the Standard Minimum Rules for the Administration of Juvenile Justice, VII Congress of the United Nations Bei-jing, 1985; for adults, alternative measures to detention, as recommended by the resolutions of the Council of Europe and the United Nations.

2. Comparison and Evaluation of the effectiveness of interventions delivered for children and young adults.  

3. Test the operational procedures system used for the most representative cases especially in re-lation to the inter-institutional collaboration between operators involved in juvenile and ordinary justice and police, courts, local services, etc..

4. Verify the system of rules and regulations affecting international resolutions: training of media-tors, procedures for the protection of the parties, legislation to protect the rights of victims.
5. Verify the effectiveness of interventions implemented in the field of the restorative justice and mediation in the juvenile justice system and the ordinary justice.

6. Building a vision of restorative justice and a shared methodology of work between all profes-sionals and institutions police.

ACTIVITIES:
1.    Analysis and mapping of experiences of restorative justice and criminal mediation.
2.    Analysis of the mediator system, their cultural profile, training and experience in the field.
Organisation of focus groups on the integrated working.
3.    Organisation of multiagency focus groups on the restorative justice.
4.    Creation of a scientific-technical board for the monitoring of the actions.
5.    Organization of seminars and / or study visits in the participating countries with the in-volvement of experts and institutions
